Deed Restrictions
Also known as the “covenants”. It is a legal document that was created by our developer, A.L. Bell that conveys the purpose and use of the properties in the Clear Springs Park subdivision. The document is a contract that is legally binding to each property owner in the subdivision.
Adherence is not voluntary. Deed Restrictions are different from the Property Owners Association (POA). Membership in the POA is encouraged but it is voluntary. Even if you are not a member of the POA, you still must adhere to the Deed Restrictions.
Deed Restrictions limit what can be build here and how the property may be used. Deed Restrictions "go" with the land; so if a property owner sells, the next owner is also bound by the same restrictions. Every ten years, we go through a process of consent (the renewal) by the property owners in order for the restrictions to stay in effect.
Some of the elements of the Deed Restrictions are:

All tracts are to be used for residential purposes only

Designated minimum square footage of each home

Setback of the home from the front and side property lines

No property may be used for a dumping ground for rubbish

Inoperative vehicles cannot remain onsite for more than 30 days

No shooting of firearms or hunting
What would happen if we did not renew the Deeds and Covenants?
Answer - the restrictions within the document become null, opening the prospect of using the land in ways the majority of the residents find objectionable such as: converting a tract to a disposal dump; tearing down a residence and building a convenience store, a bar, or an apartment complex.
